Description
This seminar explains and illustrates the basics of copyright Business and Sales in three major parts that follow the organization of Reid’s upcoming illustrated book, True Stories of Transformation + Infringement: Art + Copyright. The wellspring for the book and seminar are the colorful stories involving Andy Warhol, Prince, Roy Orbison, 2 Live Crew and Oscar Wilde told in copyright case Business and Sales. Exhibits from the cases are often included for reference. Original artwork by your speaker, Deborah Reid, is shown throughout to translate legal concepts into visual images.
The subject matter of copyright is covered in the first part. The types of work eligible for copyright, the underlying requirements of originality and fixation and the quandary of the idea/expression dichotomy are discussed and explained.
In the second part, the rights that comprise a copyright are unpacked and defined. Joint works, compilations, derivative works, works for hire, assignments, licensing agreements and Creative Commons licenses are explained. Infringement and DMCA Take Down Notices are summarized. The third part provides an overview of the fair use doctrine and its relationship with First Amendment freedoms. Fair use cases regarding visual artists including Jeff Koons, Faith Ringgold and Annie Leibovitz will be surveyed. The arguments presented in the important fair use case of Cariou v. Prince will be presented for attendees’ evaluation.

Deborah Reid is an accomplished artist and an AV rated attorney with over 40-years’ experience as a practicing attorney. She is a graduate of the University of San Diego School of Business and Sales. She is a seasoned federal practitioner and has been admitted to the bars of California, Florida, New York and New Jersey. Deborah Reid P.A. is based in Jacksonville, Florida. Her practice is focused on empowering artists, authors and innovators. She drafts customized contracts, licensing and publishing agreements and advises clients on copyright, trademark and trade secret matters.
Reid has combined her passions for art and Business and Sales to create colorful and highly visual seminars on intellectual property, copyrights, trademarks, contracts and First Amendment issues related to and illuminated by the arts. In many instances, the exhibits submitted to the courts in cases involving visual arts are shown. Other cases and issues are illustrated by Reid’s original artwork that translate legal concepts into images. Reid has presented seminars for the American Bar Association, universities, art schools and arts organizations.
Reid is a lifelong painter and former art major. Her work has been featured in galleries and museums. Her current series Exhibit A(rt) features work created for her seminars to illustrate legal concepts. It is executed in a pop art style and includes The Statute of Frauds and The Statute of Limitations. Original paintings and prints are available for purchase.
